Terms of Service

1. About FieldWitness

FieldWitness is a privacy-first iOS app for capturing GPS-stamped field photos, organizing inspection projects, verifying file integrity locally, and generating professional PDF reports.

The Service is intended for professional and personal field documentation—including construction inspections, property maintenance, equipment installation, and insurance evidence—not as legal, engineering, or surveying advice.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use FieldWitness. If you use the app on behalf of a company, you confirm that you have authority to bind that organization to these Terms.

3. License to use the app

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the FieldWitness app on Apple devices you own or control, subject to these Terms and Apple's App Store terms.

You may not copy, modify, reverse-engineer, decompile, distribute, sell, or lease any part of the Service except as permitted by applicable law.

4. Your content and responsibilities

You retain ownership of photos, notes, reports, and other content you create with FieldWitness ("User Content"). You are solely responsible for User Content and for ensuring you have the right to capture, store, and share it—including obtaining consent where required.

FieldWitness stores User Content locally on your device. We do not access your project files unless you send them to us voluntarily (for example, in a support request).

5. Acceptable use

You agree not to use FieldWitness to:

• Violate any applicable law or regulation
• Infringe the intellectual property, privacy, or other rights of others
• Capture or distribute content in places or situations where photography is prohibited
• Misrepresent imported photos as captures made inside the app
• Attempt to interfere with the security or operation of the Service

6. FieldWitness Pro and purchases

FieldWitness offers a free tier and optional FieldWitness Pro upgrades through Apple's In-App Purchase system. Prices, features, and availability may vary by region and may change with notice where required.

FieldWitness Pro may be offered as a one-time lifetime purchase and/or as an auto-renewing subscription, depending on the options shown in the app at the time of purchase.

Lifetime purchases are one-time charges with no recurring subscription fee. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period in your App Store account settings.

All billing, refunds, and payment disputes are handled by Apple under its App Store terms. We do not process payment card information directly.

7. No account; device-based access

FieldWitness does not require a user account. Pro entitlements are tied to your Apple ID and restored through Apple's purchase restore flow.

You are responsible for maintaining your device and backups of important project data. We are not responsible for data loss caused by device failure, loss, or app removal.

8. GPS, timestamps, and evidence disclaimer

FieldWitness attaches available location, time, and device metadata to help document field conditions. GPS accuracy depends on device hardware, signal, and environment.

FieldWitness is a documentation tool. It does not guarantee legal admissibility, survey-grade accuracy, or suitability for any specific regulatory requirement. You should verify evidence requirements for your jurisdiction and use case.

9. Intellectual property

The FieldWitness app, website, trademarks, logos, and documentation are owned by CodeMXM or its licensors and are protected by applicable intellectual property laws.

These Terms do not grant you any rights to our branding except as needed to use the Service as intended.

10. Third-party services

The Service integrates with Apple platform services (App Store, iCloud backup if you enable it, share sheet destinations) and RevenueCat for purchase validation. Your use of third-party services is subject to their own terms and policies.

This website may link to external resources. We are not responsible for third-party websites or services.

11. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that GPS, timestamps, or exported reports will meet every professional or legal standard.

12. Limitation of liability

To the fullest extent permitted by law, CodeMXM and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, business, or goodwill arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid for FieldWitness Pro in the twelve (12) months before the claim, or USD $50 if you use the free tier.

13. Termination

You may stop using FieldWitness at any time by deleting the app. We may suspend or terminate access to the Service if you violate these Terms or if required by law or Apple platform policies.

Sections that by nature should survive termination—including disclaimers, limitations of liability, and intellectual property—will survive.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use after changes constitutes acceptance of the revised Terms.
